Upcoming School Holidays & Your Children

Have you worked out visitation for the upcoming school holidays?

Many parents love to spend that extra time with their children.  As a result school holidays are a very important time for some families, however, it can also be a difficult occasion to negotiate for those who are separated and sort out what arrangements should be in place for the children.

 

Do you have an existing Court orders in relation to parenting matters?

If you do, consider what arrangements, if any, are provided for in the orders.   In most matters we would recommend that unless you can negotiate or mediate alternate agreements, you follow the orders.  If you are concerned about following those orders, seek immediate legal advice.  If you fail to follow the orders, the other party may file a contravention application against you.

 

Do you have a parenting plan in place?

If you do, consider what arrangements, if any, are provided for in the plan.  Whilst your parenting plan is not legally binding, if you deviate from the plan without the agreement of the other parent you risk upsetting parenting arrangements.  If your matter ended up in court arising from such a unilateral change it may have repercussions for you.

 

No orders or parenting plan?

If there are no orders and no parenting plan or they make no provision for school holidays, then your first step should be to attempt to work out arrangements with the other parent.

 

If these fail, aren’t in place, can’t come to an agreement or you don’t feel comfortable communicating with the other parent directly ?

If this fails or you don’t feel comfortable communicating with the other parent directly, then family dispute resolution (mediation) would likely be the next recommended step.  Alternatively, you may wish to attempt negotiations though a family lawyer.  Regardless, it is at this time we recommend you seek legal advice about your circumstances and future steps from an experienced family lawyer. Throughout this, remember you should remain child focused and given consideration to the future.  You may not be able to work out arrangements for this year, but there are future years.
