Parenting Plans for Neurodivergent Children: Navigating High-Conflict Separation in Queensland

Raising a child with “special needs” whether they are on the Autism Spectrum (ASD), have ADHD, or live with physical or intellectual disabilities requires a level of dedication that most families never have to contemplate.
In Queensland, the “triple threat” of carer fatigue, financial strain, and high-conflict communication often leads to higher rates of separation in these families. When these relationships break down, standard legal templates often fail because they don’t account for the unique ecosystem of support required for a neurodivergent child.

The School Environment: More Than Just an Education

For a child on the spectrum, school is often their primary source of social structure and therapy. In high-conflict separations, disputes over schooling can be devastating.

When drafting your parenting orders, we consider:

  • The IEP/ILP Team: Who attends the meetings for the Individual Education Plan? In high-conflict cases, we recommend orders that allow both parents to receive school minutes simultaneously to avoid information “gatekeeping.”

The NDIS is a game-changer but can become a point of contention. If parents cannot agree, the NDIS may appoint only one parent as the “Child Representative,” giving them total control over providers and funding.

To prevent this, your parenting orders should specify Joint Decision-Making for service providers and ensure both parents have visibility of the NDIS portal to prevent the misuse of therapy hours.

 

Managing High-Conflict: Parallel Parenting

When communication becomes toxic, trying to “co-parent” can cause a child’s symptoms to spike. In these cases, we often use the Parallel Parenting model. This allows each parent to exercise their own style within their home while adhering to a strict, court-ordered “Master Schedule” for the child’s therapies and routines.

Can the NDIS decide which parent my child lives with?

No. The NDIS manages funding and supports, not custody. However, the Federal Circuit and Family Court of Australia can make orders that influence how the NDIS plan is managed, such as who is the “Primary Correspondent” or how therapy sessions are attended.

What if my ex-partner refuses to follow the child’s rigid routine?

For a child with ASD, routine is a medical necessity, not a lifestyle choice. We can draft specific Parenting Orders that mandate consistency in medication, diet, and therapy schedules, making these requirements legally enforceable.
